Subject Access Requests

Subject Access Requests ( SAR ) are a really useful thing to do when preparing for your case

Whilst you wait for the NMC to come back to you with their evidence you can use a SAR to gather your own. This may include:

  • emails to and from your referrer to the NMC
  • emails internally through departments in the NMC eg Screening teams to investigating teams to Case Officers
  • information your employer held on you in HR

    To exercise your right of access, follow these steps:

    Step 1

    • Identify where to send your request.
    • Think about what personal data you want to access.

    Step 2

    • Make your request directly to the organisation.
    • State clearly what you want.
    • When requesting to the NMC quote your case reference number and PIN number
    • If requesting from other organisations use your Date of Birth, Full Name and Address.

The Information Comissioners Office is there to help you too and if the place you are requesting a SAR from is not complying they can step in to ensure your request is dealt with appropriately

How to be successful in your request

  • Keep your request short and simple
  • Do more than one request eg do one for one set of information and another for another
  • Don’t give additional text on why you want it – it’s your info you are entitled to see it
  • Read the ICO website so you know your rights and use the templates provided there  

If you think that information held on you is incorrect you have the right to have it corrected – the ICO provide guidance here on this issu

[Your full name and address and PIN and Case Number)

Please supply the data about me that I am entitled to under data protection law relating to: [give specific details of the data you want, for example:

  • emails between ‘officer A’ and ‘officer B’ (from x date to y date) about me
  • CCTV camera situated at (‘location E’) on XX date between x o’clock and y o’clock
  • copies of statements provided to the NMC on XX date
  • custody record of 9-10 October 2017

If you need any more data from me, or a fee, please let me know as soon as possible.

It may be helpful for you to know that data protection law requires you to respond to a request for data within one calendar month.

If you do not normally deal with these requests, please pass this letter to your Data Protection Officer, or relevant staff member. If you need advice on dealing with this request, the Information Commissioner’s Office can assist you. Its website is ico.org.uk or it can be contacted on 0303 123 1113.
